If you are involved in an accident as a pedestrian, the key things to remember are to report the accident to the police as soon as you practically can and get medical attention. Note that shock and trauma can often delay the onset of symptoms so it is important to see a doctor or go to a hospital as soon as possible regardless of what you are feeling.

The extent of your injuries will determine what else you can do at the time of the accident, but if at all possible get the names and contact details of any witnesses.

For a claim for compensation to be successful, evidence which demonstrates that somebody else was responsible must be made available. In the case of road traffic accidents, it will be another vehicle driver or a bystander near or at the site of the accident.

One way to make sure evidence is documented is to put in an accurate report to the police when they arrive on the scene of the accident. It is very rare for any road accidents not to have police on the scene reasonably quickly after the event. It is also advised you get the names and contact details of witnesses and if at all possible take photographs at the scene.

You will need to see your doctor or make a visit to a hospital for medical attention. Even if your accident was fairly minor, it is still a good idea to do this as the onset of some symptoms can be masked by shock.

You may of course need to rely on somebody else at the scene, such as somebody else who was in your vehicle at the time or a bystander to help with any of the above if you have had a serious injury and have been hospitalised soon after the accident.

Evidence which has been collected sooner rather than later will always be the most valuable and in the same instance, the sooner you are able to instigate legal proceedings the better too. Most claims for compensation are not normally possible after three years from the date of the accident.

Making generalised claims about compensation payments isn’t recommended and is near impossible as the situation around each accident can differ greatly, it is possible to provide the background information and the elements which go into deciding the final compensation figure for an accident victim.

The amount is worked out based on the level of pain and suffering resulting from the injury combined with an amount paid to compensate for everything which has been lost due to the accident.

These things include activities which are no longer possible, such as being able to drive, work, and play sport or, in more serious circumstances, being able to see, hear or walk. The loss of normal activities and abilities could be short-term, long-term or even lifetime and therefore the compensation payment must take into consideration this potential time factor.

Compensation amounts also take into account the loss of earnings due to the injury as well as additional expenses which are necessary because of the injuries.
